1. General provisions
1.1. These online shop terms (the “Terms”) are a legally binding document between the Buyer and the Seller (the “Seller”) setting out the rights and obligations of the Parties.
1.2. The Seller reserves the right to change, correct or supplement these Terms at any time. The Buyer is informed of changes to the Terms on the online shop’s website.
2. Conclusion of the purchase–sale contract
2.1. The purchase–sale contract between the Buyer and the Seller is considered concluded when the Buyer composes and submits an order in the online shop, having first read these Terms.
3. Rights of the Seller
3.1. Where significant circumstances arise, the Seller may temporarily or permanently suspend the operation of the online shop without giving the Buyer prior notice.
3.2. If the Buyer attempts to harm the operation, stability or security of the online shop, or breaches their obligations, the Seller may restrict or suspend their access to the online shop without warning.
4. Obligations of the Seller
4.1. The Seller undertakes to make the services of the online shop available, on the operating conditions set out in these Terms.
4.2. The Seller undertakes to deliver the goods purchased by the Buyer using the delivery method chosen by the Buyer, on the conditions set out in these Terms.
4.3. Where, due to unforeseen circumstances, the Seller cannot deliver the goods ordered in the online shop, the Seller may terminate the purchase–sale contract after informing the Buyer. The Seller may offer an equivalent product. If the Buyer declines, the Seller undertakes to refund the money paid within 3 working days.
4.4. Where the Buyer exercises the right provided for in clause 5.2 of these Terms, the Seller undertakes to refund the money paid by the Buyer within 5 (five) working days of the day the returned item is received.
4.5. The Seller may withhold the refund until the goods have been returned to the Seller, or until the Buyer supplies evidence that the goods have been sent to the Seller, whichever happens first.
5. Rights of the Buyer
5.1. The Buyer has the right to purchase goods in the online shop in accordance with these Terms.
5.2. The Buyer has the right to withdraw from the purchase–sale contract concluded in the online shop by notifying the Seller in writing no later than 14 (fourteen) calendar days from the day the goods were delivered.
5.3. The Buyer may exercise the right described in clause 5.2 only where the item has not been damaged, its appearance has not materially changed, and it has not been used.
6. Obligations of the Buyer
6.1. The Buyer must pay for the goods purchased and accept them in the manner set out in these Terms.
6.2. If, at the time of delivery, the Buyer refuses to accept the goods without good reason, the Buyer must, at the Seller’s request, cover the cost of returning the goods.
6.3. At the time of delivery the Buyer must check the condition of the parcel and the goods together with the Seller or the person delivering the parcel.
6.4. By using the online shop, the Buyer confirms that they agree to these terms of purchase and sale and undertakes to comply with them.
7. Prices
7.1. Prices in the online shop are stated in euros. On confirming the order, a delivery charge is added to the total, where one applies.
8. Ordering and payment
8.1. On visiting the online shop, the Buyer selects the goods they want and places them in the shopping basket. Once the basket is composed, the Buyer enters the personal data required to fulfil the order: their first name, surname, the address the goods are to be delivered to, a telephone number, and any additional information that may matter for delivery.
8.2. The Buyer confirms that they have read these terms and confirms the order.
8.3. Payment is possible using the online banking services of Swedbank, SEB, Citadele and Luminor, and by Visa / MasterCard payment cards. Payments are made in euros. Payments are processed using the https://montonio.com/ payment platform.
9. Delivery
9.1. When placing an order, the Buyer must provide an exact delivery address.
9.2. The Buyer must accept the goods in person. If the Buyer cannot accept the goods in person but the goods have been delivered to the address given by the Buyer, the Buyer has no right to raise claims about the goods having been handed to another person.
9.3. The Seller delivers the goods within the periods stated in the product descriptions.
9.4. The characteristics of every product sold are set out in the description accompanying that product. The Seller is not responsible for the colour, shape or other parameters of the goods shown in the online shop differing from the real size, shape and colour of the goods because of the characteristics of the Buyer’s monitor.
9.5. If the Buyer withdraws from the purchase–sale contract, all sums paid by the Buyer are refunded, including the delivery costs paid by the Buyer.
10. Other provisions
10.1. Goods of satisfactory quality may be returned within 14 days of the day they were received. Defects in goods sold that are not of satisfactory quality are remedied, and such goods are replaced or refunded, in accordance with European Union consumer protection law and the applicable national law.
10.2. The following conditions apply when returning goods:
10.2.1. The returned item must be in its original, undamaged packaging (this point does not apply where the item returned is not of satisfactory quality);
10.2.2. The item must not have been damaged by the Buyer;
10.2.3. The item must be unused and must not have lost its saleable appearance: labels undamaged, protective films not removed, and so on (this point does not apply where the item returned is not of satisfactory quality);
10.2.4. The returned item must be in the same configuration in which the Buyer received it (this point does not apply where the item returned is not of satisfactory quality);
10.2.5. The Seller may refuse to accept goods returned by the Buyer where the return conditions have not been met;
10.2.6. Returns are carried out in the manner set by the Seller within 14 (fourteen) days of the day the goods were received (this point does not apply where the item is not of satisfactory quality — in that case the return is carried out within the statutory guarantee period);
10.3. The return and exchange of goods of satisfactory quality is carried out under the consumer’s right of withdrawal from distance contracts provided for in European Union consumer law.
10.4. Money paid for goods accepted by the Buyer but subsequently withdrawn from is returned to the Buyer’s account no later than 5 (five) days from the day the goods are returned to the Seller, unless the Seller and the Buyer agree otherwise.
11. Final provisions
11.1. The Seller is a sole trader registered in the Republic of Lithuania. These Terms are governed by the law of the Republic of Lithuania; this does not deprive a consumer of the protection afforded to them by the mandatory rules of the country in which they are habitually resident.
11.2. All disagreements arising from the performance of these Terms are settled by negotiation. Where agreement cannot be reached, a consumer may apply to the consumer protection authority of their country of residence or use the European Union’s online dispute resolution platform.
11.3. The Parties are released from performing their obligations under these Terms where performance is impossible due to unforeseen circumstances beyond the Parties’ control (force majeure).
